This document ("General Terms") outlines the conditions under which we provide our website-building services and tools, templates, features, and other related offerings available at [hoteicreators.com] (collectively, the "Services"). Additionally, this document addresses key legal aspects of the relationship between you and us.
These General Terms, along with:
form a binding agreement (the "Agreement") the terms of which you must accept in order to use the Services.
In addition to the Agreement, we recommend that you carefully read our Privacy Policy, which describes how we process personal data in connection with the Services.
Offline Agreements. If you have signed a separate offline agreement to use our Services, the terms and conditions of that offline agreement shall govern our relationship with respect to the use of the Services to the extent that the offline agreement explicitly covers such use. In cases where the offline agreement is silent on specific aspects or conflicts arise, the terms of this Agreement will apply to fill in any gaps or resolve inconsistencies, provided they do not contradict the offline agreement’s express provisions.
When we say "we" or “Hotei”, we mean Venture Chain SRL, a company headquartered in Str. Rapsodiei, Nr. 8, Ap. 6, Cluj-Napoca, Romania, sole identification number RO45530864.
When we say "you" or "your", we mean the organization on behalf of which you agree to this Agreement. If you are not representing an organization, you, as an individual, will be bound by the terms of the Agreement. In certain instances, you will be referred to as our "Customer".
Together, we form the “Parties” to the Agreement.
By creating an account, purchasing a subscription, or using or inviting others to use the Services, you express your agreement with the Agreement. If representing an organization, please ensure you are an authorized representative capable of entering into the Agreement.
The Representative and End Users
When establishing your account, the first user will serve as your designated representative ("Representative") with primary access to manage and configure account settings. As the Services may allow and depending on your subscription, you may assign additional individuals as users with varying access levels (collectively with the Representative, "End Users"). You retain full authority to manage the roles and access of End Users, including the Representative, and may replace or restrict access for any End User. If you decide to replace the Representative, we will notify them of this change, and they agree to cooperate reasonably to ensure a smooth transition.
You are responsible for ensuring that all End Users are over the age of 18, as the Services are not intended for individuals under 18. We will not be liable for how you or your End Users use the Services. You bear sole responsibility for providing the hardware, software, and internet connectivity required for End Users to access the Services.
Account registration and security
You must provide accurate and complete information when registering an account and agree to notify us if such information has changed. We have undertaken commercially reasonable efforts to ensure the safety and security of our Services. However, you shall be solely responsible for the security and proper use of login credentials such as passwords and IDs, as well as the security of the hardware, software, network infrastructure, and other devices used to access the Services. You must immediately inform us if there is reason to believe that the Services are or may be accessed in an unauthorized way using your credentials. We reserve the right to instruct you on appropriate measures that you must implement to secure your account. All activity in connection with your account will be presumed to have been conducted by you, and you maintain sole responsibility for such activity.
